Partner Visa (Temporary) (Class UK) (Subclass 820) and Partner Visa (Residence) (Class BS) (Subclass 801) are two-stage visa processes open to individuals seeking to stay in Australia as a couple (sponsor).

Key Eligibility requirements

  • An Australian citizen, permanent resident or eligible New Zealander must be your spouse or de facto partner.

  • There must be evidence that your relationship is exclusive, committed, genuine, and continuing.

  • The following four factors must be met cumulatively by you and your partner:

    • Aspects of the relationship that involve joint finances.

    • A household arrangement that is joint in nature.

    • Social aspects of a relationship.

    • The nature of the couple’s commitment to each other.

  • Couples who are in a de facto relationship must have been together for at least 12 months. However, there are exceptions to this requirement including when the relationship has been registered under a law of a State or Territory prescribed in relevant legislation.

  • Health and character requirements must be met.
