Offshore Partner (Subclass 309/100)

The Partner Visa (Provisional) (Class UF) (Subclass 309) & Partner Visa (Migrant) (Class BC) (Subclass 100) is a two-stage visa process for people wanting to move to Australia on the basis of being in a relationship with an eligible partner (sponsor).

Highlights

  • To lodge a valid visa application, you must be outside Australia.

  • This is a 2-stage process, in applying for a Partner visa, you will be applying for the subclass 309 Provisional and the subclass 100 Permanent visas concurrently.

  • You can enter and stay in Australia until a permanent visa decision is made.

 

Key Eligibility requirements

  • An Australian citizen, permanent resident or eligible New Zealander must be your spouse or de facto partner.

  • There must be evidence that your relationship is exclusive, committed, genuine, and continuing.

  • The following four factors must be met cumulatively by you and your partner:

    • Aspects of the relationship that involve joint finances.

    • Join nature of the household arrangement.

    • Social aspects of a relationship.

    • The nature of the couple’s commitment to each other.

  • Couples who are in a de facto relationship must have been together for at least 12 months. However, there are exceptions to this requirement including when the relationship has been registered under a law of a State or Territory prescribed in relevant legislation.

  • The requirements for health and character must be met.
