Key Eligibility requirements
An Australian citizen, permanent resident or eligible New Zealander must be your spouse or de facto partner.
There must be evidence that your relationship is exclusive, committed, genuine, and continuing.
The following four factors must be met cumulatively by you and your partner:
Aspects of the relationship that involve joint finances.
A household arrangement that is joint in nature.
Social aspects of a relationship.
The nature of the couple’s commitment to each other.
Couples who are in a de facto relationship must have been together for at least 12 months. However, there are exceptions to this requirement including when the relationship has been registered under a law of a State or Territory prescribed in relevant legislation.
Health and character requirements must be met.
